FORTRESS FLOORS – TERMS & CONDITIONS

Definitions

"Contractor" refers to Fortress Floors.

"Client" refers to the person or entity engaging services.

"Works" refers to epoxy flooring, surface preparation, coatings, and related services.

Scope of Work

All works will be carried out as agreed in writing (quote, invoice, or agreement). Any additional work outside the agreed scope will be quoted separately, as a variation.

Surface Preparation & Existing Conditions

The Client acknowledges concrete substrates may contain hidden defects not visible prior to commencement. These include, but are not limited to, moisture content, structural cracking, weak or contaminated concrete, previous coatings or sealers.

Fortress Floors will take reasonable steps to prepare the surface professionally but does not guarantee performance where underlying substrate issues exist.

Moisture & Adhesion Disclaimer

Moisture within concrete can cause delamination/peeling, bubbling and coating failure. Moisture testing may be conducted where possible; however, results are not always conclusive and conditions may change over time.

Fortress Floors is not liable for failures caused by rising damp, hydrostatic pressure or subsurface moisture.

Colour & Finish Variations

The Client acknowledges that epoxy and flake systems may vary in colour tone, texture and gloss level. Variations may occur due to batch differences, lighting conditions, application environment and natural material behaviour.

Minor variations are not considered defects.

Manufacturer & Product Limitations

Materials used are supplied by third-party manufacturers. Fortress Floors applies products according to manufacturer guidelines; however, no responsibility is accepted for manufacturer defects, product discolouration over time and UV-related fading or yellowing.

Any product-related claims are subject to manufacturer warranties only.

UV Exposure & Discolouration

Epoxy coatings are not UV stable unless specified. Exposure to sunlight may cause yellowing, fading and colour change over time.

This is a known characteristic, not a fault.

Wear & Tear

The Client acknowledges that flooring systems are subject to normal wear and tear including and not limited to scratches, chemicals, scuffing, tyre marks and impact damage.

These are not covered under warranty.

Environmental & Weather Conditions

Application is dependent on temperature, humidity and weather conditions. Fortress Floors reserves the right to delay or reschedule works due to unsuitable conditions.

The Contractor is not liable for delays caused by weather or environmental factors.

Travel Charges

Projects located outside the Perth metropolitan area may incur additional travel charges. Travel fees will be calculated based on distance and site conditions and quoted separately prior to commencement of works. These charges are in addition to the quoted project cost.

Curing & Use of Floor

The Client agrees not to use the floor until advised curing time has passed. Typical curing for light foot traffic is 24–48 hours after product application and vehicle traffic is 7 days after product application.

Damage caused during curing is the Client's responsibility.

Access & Site Conditions

The Client must provide clear and safe access and remove all items from the work area. Additional charges may apply for cleaning, obstructions or delays caused by site conditions.

Cracks & Repairs

Crack repairs may be completed where agreed; however, cracks may reappear over time due to movement.

No guarantee is provided against future cracking.

Warranty (Workmanship Only)

Fortress Floors provides a limited workmanship warranty of 5 years from date of completion, covering application defects directly caused by installation.

This does NOT cover moisture-related failure, structural movement, wear and tear, UV damage and misuse or neglect.

Licensing & Insurance

Fortress Floors is fully licensed and insured to carry out epoxy flooring works in Western Australia. All works are completed in accordance with relevant industry standards and local building regulations.

Proof of insurance and licensing is available upon request.

Dispute Resolution

Any disputes arising from this agreement shall be governed by the laws of Western Australia and the jurisdiction of the Western Australian courts. Disputes shall be resolved through good faith negotiation, and if necessary, through mediation or arbitration as agreed by both parties.

Limitation of Liability

To the maximum extent permitted by law, Fortress Floors is not liable for indirect or consequential losses, loss of use or income or damage beyond the value of the works.

Payment Terms

A 50% deposit is required prior to commencement and full payment is due upon completion unless otherwise agreed. Late payments may incur fees.

Cancellations

Cancellations may result in loss of deposit and costs incurred prior to cancellation may be charged.

Intellectual Property

All photographs, designs, and documentation created during the project remain the property of Fortress Floors and may be used for portfolio, marketing and promotional purposes unless otherwise agreed in writing.

The Client grants Fortress Floors permission to photograph the completed works and use these images for business promotion.

Acceptance

By accepting this quote or allowing works to commence, the Client confirms they have read and accepted these Terms & Conditions.
